Forms of running the business
EU citizens willing to carry out a business action in Poland can choose between various organizational and legal forms of entities:
- Self-employment (a sole person activity)
- Partnerships: registered partnership, professional partnership, limited partnership, limited joint-stock company
- Capital companies: limited liability companies and joint-stock companies.
Additionally, foreign persons carrying out their business activity in other country, can establish its branches of their company in Poland.
According to Treaty's establishing the European Community provisions, a citizen of a EU member country can start a business in another EU member country without any limitations, and on terms compulsory citizens of this country. Citizens of EU member countries can acquire shares and carry out a business activity in any of the above mentioned legal forms.
Establishing capital companies or branches is the most profitable. We advise against running the enterprise in form of a self-employment. This form, because of its simplicity, does not guarantee practically any protection of personal assets of the person running business activity, on the other hand it limits possibility of the development.
There are some limitations for citizens of countries which are not EU members, neither the European Free Trade Agreement. They can run business activity only in the form of limited partnership, limited joint-stock partnership, limited liability company or joint-stock company. They also have right to take up or acquire shares in above mentioned entities.
